Terms of Service

1. Acceptance of Terms

By accessing and using Screenly ("the Service"), a product of Nexaurai and powered by Thomji Group LLC, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. All such guidelines or rules are hereby incorporated by reference into the Terms of Service.

2. Description of Service

Screenly provides an AI-powered interview and candidate evaluation platform containing features such as automated video interviews, AI-driven analysis, and candidate management tools. You acknowledge and agree that the Service is provided for professional recruitment purposes and that the AI analysis is intended to support, not replace, human hiring decisions.

3. User Accounts & Security

To access certain features of the Service, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your password and identification.
• Accept all responsibility for any and all activities that occur under your account.
• Notify Screenly immediately of any unauthorized use of your account.

4. Intellectual Property

The Service and its original content, features, and functionality (including but not limited to the AI algorithms, design, and software) are and will remain the exclusive property of Thomji Group LLC and its licensors. However, you retain all rights to the data (resumes, videos) you upload to the Service ("User Content"). By uploading User Content, you grant Screenly a license to use, process, and analyze such content solely for the purpose of providing the agreed services.

5. Acceptable Use Policy

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To transmit any unsolicited or unauthorized advertising or promotional material.
• To impersonate or attempt to impersonate Screenly, a Screenly employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Screenly or users of the Service.

6. Limitation of Liability

In no event shall Thomji Group LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
